Moorse � City Administrator's Report <br /> Title City Administrator �'1 �� <br /> Item Description : Mn/DOT Property Acq sition Settlement <br /> In late 2003, Mn/DOT acquired property west of Old Crystal Bay Road and south of the <br /> BNSFRR (the Carlson property) from the City as right-of-way for the New Highway 12 Project. <br /> The property was acquired through a quick-take condemnation process, because the City and <br /> Mn/DOT could not reach agreement regarding the value of the property. The condemnation <br /> commissioners determined the value to be $231,000. <br /> The City appealed the condemnation commissioners' award to District Court. The District Court <br /> judge required the City and Mn/DOT to attempt to reach a settlement through a mediation <br /> process. The mediation process was held on Thursday, December 14. The City and Mn/DOT <br /> did reach a settlement through the mediation process. The settlement established the value of the <br /> property as $340,000. It is recommended that the Council approve the settlement. <br /> COUNCIL ACTION REQUESTED: <br /> Motion to approve the settlement regarding the Mn/DOT acquisition of the Carlson property at a <br /> value of$340,000. <br />
