The mayor later si��ed an a�-cement correcting the sihtation but that the City ' does not have a signed copy by the developer. Gaffi-on commer7ted it would Ue difficult to locate this I developer. Murphy inquired whether these fees were originally paid and whether these fees have Ueen paid twice. i I Gaffron stated an argument could be made that the developer paid to subdivide the land in a certain , mamler, wllich never happened, and that now these applicants are paying fees to accomplish the same thing that was never followed ttu-ough with by that developer. � Murphy stated he would Ue in favor of waiving the fees if the City already collected some fees for the original platting. Morrison commented Mr. Stic}aley had pointed out that the road cannot be both a puUlic and a private road and that they have had to incur thousands of dollars to make it a private road. Brokl stated this is the reason why the City now requires surveys showing the abutting lands. Ctutis stated the applicant has applied far a conditional use permit in order to do some improvements to the property, conduct land alterations in excess of 500 cuUic yards between the building and the right-of way of County Road 6, construct a new church sign at the corner of rei-�idale and County Road 6, consiruct an 11' high, 12' by 24' storage shed, and consh-uct a memorial garden including a columbarium adjacent to the parking lot. Any improvement proposed by a use operating conditionally on a property within a residential zoning dish-ict requires review and appi-oval of a new conditional use permit. I�l addition to the conditional use permit review, ihe applicant is also requesting a variance to allow the proposed monument sign to exceed lhe 10-foot maximum requirement by 6 inches. I'AGESof15
