Based upon one or more of the above fiildings, the Orono City Council hereby <br /> grants a condiCional use permit per Orono Municip�l loning Code Seetion 78-418 (3) <br /> conduct land alter�tions in the area betweeil the church buildinb and County Road 6, and <br /> to construct a 12' � 24' shed; and grants variances to Seciion 78-1467 to allow placement <br /> of a sign with 42 s.f. and 10'6" in height, subject to the following conditions: <br /> l. Council approval is based on the site plans submitted by the applicant and <br /> arulotated by City staff, attached to this Resolution as Exhibit B. Any <br /> amendments to the site plan which are not in confoimity with City codes will <br /> require fiirther Platuiing Conuilission and City Council review. <br /> 2. Any additional lighting beyond that required by the Building Code will require <br /> approval of a separate conditiona] use permit. <br /> 3. Building permits are required prior to commencement of all of the aspects of the <br /> proj ect. <br /> 4. Prior to issuance of a building permit of the grading portion of the project the <br /> applicant will provide the City with a Developer's Agreei�lent in lieu of a Letter <br /> of Credit for the iiiiproven�ents. <br /> :5. Any and alt existing and forthcoming City Engineer reconullendations shall be <br /> iiicorpoc�ated it�lo the final plans. <br /> 6. The colunibarium is specifically not approved because such approval absent an <br /> amendment of the zoning code W011l� constitute a use variance which camlot <br /> legally be granted. <br /> 7. Authorities granted by this resolution run with the property not with the applicant, <br /> but are per�nissive only and must be exercised by obtaining a building permit for <br /> the new canstruction within one year of the date of CoLulcil approval, or the <br /> conditional use permit will expire on that date (November 27, 2007). <br /> 8. Violation of or non-compliance with any of the terms and conditions of this <br /> resohition shall constitute a violation of the zoning code, shall autom�tically <br /> terininate any authority granted herein, �nd shall be punishable as a misdemeanor. <br /> P�ge 4 of 6 <br />
