Mrs. Dunkley stated they would Ue willing to work with Staff on the colors. Tut7ler inquired whether the changes that were made not at the request of the Planning Commission should be retained. Brokl recommended the cut7•ent changes be included in the motion. White amended his motion,McMillan seconded,Application#06-3238, Vogue ICF Homes on behalf of William and SueDunkley, 2709 Walters Port Laue, approving the revised plan before the City Council tonight,subject to the center gross gable being lowered to 28'/11", and subject to the incorporation of darker earthtone colors to be approved by Staff. VOTE: Ayes 4,Nays 1, Murphy Opposed. Muiphy stated in his opinion the house is out of character with the rest of the neighborhood. 9. #06-3240 CITY OF ORONO ZONE CODE SECTION 78-1 —DEFINITIONS OF `BASEMENT"AND "STORY"ZONING CODE AMENDMENT Loren Schoeuzeit, 4480 Forest Lake Landing, stated in his view the houses are getting too tall in Orono and part of the impetus for that is somewhat Uased on the City's resiriction of 15 percent sh-uctural coverage. Schoenzeit stated his concern with the ordinance is that the smaller house could lose possibly a lower level. Schoenzeit connnented Orono has the most resh•ictive Uuilding code in the Twin Cities if they compare the 15 percent siruchu•al coverage limit with other conununities. Schoenzeit indicated he would be willing to work with Plaimer Gaffi-on to protect the smaller house, noting that there are not provisions to deal with water drainage on a lot. Schoenzeit stated the City should balance the properly rigl�ts of the owners with the regulations of the City. Schoenzeit encouraged tlie Council to consider the smaller homes when reviewing this ordinance. White stated Mr. Schoenzeit did raise an interesting point and that there may be some problems with the ordinance that should be addi•essed. Gaffron stated the City does not have a functional ordinance presently concerning the definition of a story and the definition of a basement and that the City should have an ordinance that does not need interpretation. Gaffron stated Staff is proposing language that is very similar to what is contained in the PAGE 11 of'15
