A RESOLUTION GRANTING <br /> A VARIANCE TO <br /> MUNICIPAL ZONING COD� <br /> Section 78-350 <br /> FILE No. 06-3244 <br /> WHEREAS, Re-Creations, Inc, a Minnesot� Corporation, (hereinafter <br /> "Owner") is the owner of the property located at 3925 Cherry Avenue within the City of <br /> Orono (hereinafter "City") and legally described as: Lots l, 2 and the east 10 feet of Lot 21, <br /> Hickory Hill Hemiepin Cotmty, Miiuiesota(hereinafter "the property"); and <br /> WHEREAS, the Owner has niade application to the City for a lot area <br /> variance to Municipal Zoning Code Section 78-350 to allow construction of a house on a lot <br /> that is 0.39 acre when 0.5 acre is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Mirulesota Statutes and the City of Orono Zoning and Plamung Codes, the Orono Planning <br /> Commission held a public hearing on November 20, 2006, at wluch tirnes all persons desiring <br /> to be heard concerning this application were given the oppoi-hinity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #06-3244 <br /> 2. The property is located in the LR-1C zoning district, where 0.5 acre acre is the <br /> niiniinum lot area and 100 feet is the iilinimtun lot width. The property is <br /> approximately 0.39 acre in area and 119 feet in width. <br /> 3. The Platu�ing Coinmission reviewed this al�plication on November 20, 2006 <br /> and on a vote of 4 - 0 reconunended approval of the variance, based on the <br /> following f ndings: <br /> a.
