A 1tESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> S�CTION 78-1279 <br /> FILE No. 06-3238 <br /> WHEREAS, William M. and Susan K. Dtu-ikley, husband and wife, <br /> (hereinafter "Owners") are owners of the property located at 2709 Walters Port Lane within <br /> tlle City of Orono (hereinaFter "City") and legally described as: Lot 4 Block 3 W1lters Port, <br /> Hennepin County, Mirulesota(hei�einafter "the property"); and <br /> WHEREAS, for the purpose of adding a second story to the existing residence <br /> Vogue ICF Honles, Inc. (hereinafter "Applicant") has made application on behalf of the <br /> Owners to the City for variances to Municipal Zoning Code Section 78-1279 to allow a <br /> lakeshore setback of 30 feet when 75 feet is required and an average lakeshore setback to <br /> allow expansion of a house entirely forward of the average lakeshore setback; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Miiulesota Statutes and the City of Orono Zoning and Plaruung Codes, the Orono Planning <br /> Commission held a public hearing on October 16, 2006, at which times all persons desiring to <br /> be heard concerning tlus application were given the opportunity to speak thereon. <br /> NOW, THEI2EFORE, BE IT RESOLVED by the City Council of Orono, <br /> Miruiesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #06-3238 <br /> 2. The property is located in the LR-1B zoning district, where 1 acre is the <br /> minimum lot area and 140 feet is the minimum lot width. The property is <br /> a�proximately 0.4 acres in area and 300 feet in wiclth. <br /> 3. The Plaiuling Conimission reviewed this application on October 16, 2006 aud <br /> on a vote of 5 - 1 recommended approval of the variances subject to the center <br /> peak being lowerecl to 28 feet 11 inches, based on the following findings: <br /> a. The slope of the eaisting roof is veiy sh�llow. It is difficult to maintain <br /> and is not in character with other houses in the neighborhood. <br /> Page 1 oI�4 <br />
