�ONp CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 71 54 <br /> c <br /> kESHO <br /> A RESOLUTION <br /> APPROVING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-395 and 78-72 <br /> FILE NO. LA20-000071 <br /> WHEREAS, on November 12, 2020, _Jacob Stickney ("Applicant"), applied for a <br /> variance from the City Code for the property addressed 15 Stubbs Bay Road(PID 3211823340006) <br /> and legally described as: <br /> That part of the SE % of the SW 1/4 of Section 32, Township 118 North, Range 23 <br /> West of the 5th Principal Meridian described as follows:The South 264 feet of the East 462.89 <br /> feet of said SE 1/4 of SW 1/4, EXCEPT the North 123.75 feet thereof; and EXCEPT that portion <br /> thereof lying South of the following described line: commencing at a point one rod North of <br /> the Southeast corner of said SE %4 of SW 1/4, thence West 462.78 feet; and EXCEPT road. <br /> (hereinafter the"Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-395 to allow for side yard setbacks; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-72 to allow for lot area and lot width; and <br /> WHEREAS, on November 16, 2020, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS, on November 16, 2020, the Planning Commission recommended <br /> approval of the variance; and <br /> WHEREAS, on December 7, 2020 the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff; and <br /> NOW,THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the requested variance as described above based on one or more of the <br /> following findings of fact concerning the Property: <br /> FINDINGS OF FACT: <br /> 1 <br />
