The applicant is requesting a street yard setback variance to allow for an addition to the <br />existing home. <br /> <br />2. Background. The applicant is looking to convert an existing garage into living space for the <br />home. They are proposing to construct a new garage addition with porch above in the street yard. The <br />applicant originally requested 4 variances: Street yard setback, Average Lakeshore Setback, variance <br />from the driveway back up apron standards, and a driveway wider than 8’ in the 75’ lakeyard (Exhibit <br />F). The applicant submitted addition information for the Commissioners to review, Exhibit G. After <br />review by the Planning Commission, the applicant submitted amended plans, reducing the size of the <br />addition by 2 feet, eliminating 3 of the variances. The applicant is requesting a street yard setback <br />variance to allow a 16’ setback (30’ is required), Exhibit A and B. <br /> <br />The applicant has submitted additional information noting that they have redesigned the plans. The <br />applicant also included photos of a neighboring project (1973 Fagerness Point Rd) stating they would like <br />a similar outcome. While the applicant’s proposed project would be very similar in design to the <br />referenced neighbor’s (1973) final project the properties have very different existing conditions. 1973 <br />Fagerness had an existing garage and received variances which allowed them to reconstruct the <br />garage. Their reconstructed garage is roughly 4’ farther back from the street than the existing garage, <br />improving the nonconformity. Their hardcover increased from 18.5% to 21%, yet still below the allowed <br />25%; new hardcover was permitted in the 75’ lakeyard to allow for a driveway. The applicant’s additional <br />narrative and the approved plans for 1973 Fagerness are attached as Exhibits C and D. <br /> <br />2. 15.99 Deadline. The applicant made a complete application on August 30, 2020. Following the 60- <br />day rule the application review period will expire October 29, 2020. <br /> <br />3. Planning Commission Vote and Comment. The Planning Commission reviewed the presented item <br />and held the public hearing on September 21st, 2020. The applicant had submitted addition information for <br />a narrative and practical difficulty attached as Exhibit D for the Planning Commission Meeting. The <br />Commissioners reviewed the application and discussed the 4 proposed variances. Commissioners came to <br />a consensus that they could not support the application as proposed. However, with amendments to the <br />project including removal of the encroachment into the Average Lakeshore Setback, might make for a <br />stronger variance application. The Commission found that the practical difficulties submitted did not <br />support the requested variances. The Commission voted 5-0 to deny to variance request. <br /> <br />4. Public Comment <br />Three letters of public comment were received (1971, 1975 and 1981 Fagerness Pt. Rd.) Exhibit E. <br /> <br />5. Staff Recommendation. <br />Staff had recommended denial for the original application with a 4 proposed variances. <br /> <br />COUNCIL ACTION REQUESTED <br />The Council should review the amended plans and determine if practical difficulties are met.
