The <br />accessory structure is currently placed 2’ from the side property line where 7.5’ is required. The <br />applicant is proposing to add a loft to the building and raise the roof line which will increase the <br />massing of the building in the setback area. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified current placement of the structure <br />as a practical difficulty supporting the requested variance. Additionally, they have provided <br />supporting documentation regarding Practical Difficulties attached as Exhibit B, and should be <br />asked for additional testimony regarding the application. <br /> <br />Planning Staff Practical Difficulty Analysis: Regarding practical difficulty, Staff finds the <br />application has reasonable use of the property for a single family home. The existing accessory <br />building is legal nonconforming and can be re-built and maintained, or relocated. There is open <br />space on the property within the conforming building setbacks. The new roof line <br />encroachment would serve as a convenience and is not necessary for the use of the property. <br />Staff finds the practical difficulties have not been met. <br /> <br />LOT ANALYSIS WORKSHEET <br />Section 78-350 – Accessory Building Setbacks: <br />No proposed phanges to the existing setback. The project would create a new encroachment <br />with a taller roofline within the North side setbacks. The existing garage is 2’ where a 7.5’ is <br />required. <br /> <br />Section 78-1403- Structural Building Coverage: The property current has 15.8% structural <br />coverage with no proposed changes. <br /> <br />Application Summary: The applicant is requesting a side yard setback variance. <br />Staff Recommendation: Planning Department Staff finds the applicant does not meet practical <br />difficulty standards.
