The Property is located in the RR-1B One Family Rural Residential Zoning District. <br /> <br />3. The Property contains 32,658 square feet (0.75 acres) in gross area and has a defined lot <br />width of 152 feet. After exclusion of the portions of the property 33 feet from the centerline <br />of both North Arm Drive West and CSAH 19, the property contains a net area of 21,644 <br />square feet (0.5 acre) and 119.25 feet in width. <br /> <br />4. The Applicant has demonstrated that the proposed home and improvements will conform <br />to the RR-1B District setbacks and requirements. <br /> <br />5. The Applicant has proposed a Type VI septic system due to the restricted space available <br />for a standard drainfield which has been approved by the Building Official. <br /> <br />6. Applicant has applied for the following variances: <br />a. Lot Width Variance <br />b. Lot Area Variance <br /> <br />7. In considering this application for variance, the Council has considered the advice and <br />recommendation of the Planning Commission and the effect of the proposed variance <br />upon the health, safety and welfare of the community, existing and anticipated traffic <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values <br />of property in the surrounding area. <br /> <br />ANALYSIS: <br /> <br />1. “Variances shall only be permitted when they are in harmony with the general purposes <br />and intent of the ordinance . . . .” The variances requested to redevelop this nonconforming <br />lot of record, resulting in a plan which meets all of the zoning requirements, are in harmony <br />with the ordinance. <br /> <br />2. “Variances shall only be permitted . . . when the variances are consistent with the <br />comprehensive plan.” The variances proposed to develop this nonconforming lot of record <br />are consistent with the comprehensive plan. <br /> <br />3. “Variances may be granted when the applicant for the variance establishes that there are <br />practical difficulties in complying with the zoning ordinance. ‘Practical difficulties,’ as used in <br />connection with the granting of a variance, means that: <br />
