MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, September 14, 2020 <br />6:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br />Page 6 of 26 <br /> <br />now it’s part of a development. He said the Council tries to treat everyone fairly and do what makes <br />sense for the City as a whole. <br />Mayor Walsh agreed and added they think about what’s best for the community as a whole, regarding the <br />lake and all of those things. <br />Crosby noted the party who wrote the letter is not at the meeting tonight. <br />Johnson said he thinks it goes without saying that the approval ties the Council’s support for the MUSA <br />expansion into a 5-acre development. If the developer sells the property off, the Council is not setting <br />aside a MUSA expansion for this parcel as a whole in the future, instead it is tied in to this specific <br />density and asked if that is correct. <br />Mayor Walsh replied yes. <br />Barnhart noted the Comp Plan Amendment process has two steps, the first is tonight where Council <br />directs Staff to submit an application to the Met Council, who will approve the application with the <br />condition of the Council approving the final version. He said the Council will approve the final version at <br />the same time that they approve the final plat. <br />Mayor Walsh said even if the property was sold off and a different developer came in and wanted to <br />increase density beyond what is supposed to be on the books, they would still need to come back to the <br />Council. <br />Johnson asked if the MUSA is still reopened then once it changes. <br />Walsh replied yes. <br />Johnson said with that clarification he continues to second the motion. <br />Printup said to further clarify, the zoning is pretty firm. <br />VOTE: Ayes 5, Nays 0. <br />15. LA19-000048 – TIMOTHY WHITTEN O/B/0 IRWIN JACOBS 2018 REV TRUST, 1700 <br />SHORELINE DRIVE PRLIMINARY PLAT – RESOLUTION <br /> <br />Timothy Whitten O/B/O Irwin Jacobs 2018 Rev Trust, Applicant, was present as well as Mark Gronberg <br />of Gronberg and Associates, the Civil Engineer. <br /> <br />Staff presented a summary packet of information. <br /> <br />Crosby asked if the lots are considered lake lots. <br /> <br />Barnhart replied right now the lots are not considered lake lots as platted because they do not have <br />frontage on the lake. The intention is that Lot 3 will combine with Lot A with a corresponding out-lot on <br />the South side of Shoreline, those lots would then be lake lots. <br /> <br />Walsh noted the developer can’t do that until they are platted. <br />
