This application is regarding variances in order to redevelop the property with a new <br />residence. Variances for lot area, lot width, hardcover, and setback are requested. The structural <br />coverage variance initially requested has been removed. <br /> <br />2. MN§15.99 Application Deadline. The application was received on July 22nd and considered to <br />be complete on August 7, 2020. Therefore the 60-Day review period expires on October 6th. <br /> <br />3. Background/ Summary. On behalf of the new property owners, the applicant is requesting <br />variances in order to construct a new home on the property which is substandard in area and <br />width. The applicant’s initial application involved variances for structural coverage, setback, and <br />hardcover variance to permit 46.3% hardcover where 25% is permitted and a 2,396 square foot <br />footprint where 2,000 square feet is permitted. <br /> <br />After receiving feedback from the Planning Commission, the applicant revised the plans and has <br />provided a revised plan eliminating the structural coverage variance and reducing the hardcover <br />variance requested. The proposed home footprint is now 1,999 square feet and complies with the <br />2,000 square foot limitation for structure. The proposed hardcover has been reduced from 46.3% <br />to 42.4%; a 331 square foot hardcover reduction. <br /> <br />4. Planning Commission Vote and Comment. On August 17th, the Planning Commission held a <br />public hearing. Following the public hearing the Planning Commission voted 7-0 on a motion to <br />deny the variance based on the structural coverage level proposed. The Commission concurred <br />with the staff recommendation which supported variances for lot area, lot width, setbacks, and <br />hardcover once the structural coverage level was brought to the conforming level. <br /> <br />5. Public Comment. The adjoining neighbors have signed the adjacent property owner <br />acknowledgment form. To date, no public comments have been received. <br /> <br />6. Staff Recommendation. The applicant has addressed the primary concern of both Staff and the <br />Planning Commission in proposing a footprint which complies with the structural coverage <br />limitation. No structural coverage variance is requested. <br /> <br />Planning staff finds there are practical difficulties supporting the requested variances; staff <br />recommends approval of the revised plan. A draft approval resolution has been provided. <br /> <br />COUNCIL ACTION REQUESTED <br />Council should consider a motion to adopt or amend the attached resolution approving lot width, lot area, <br />hardcover, front setback and driveway setback variances according the revised plan. <br /> <br />Exhibits <br />A.
