In no event shall the city be liable for any payment which 1720 <br />may be due because of a subsequent reduction in the application percentage of land or equivalent 1721 <br />market value in cash to be dedicated. 1722 <br />Secs. 82-228—82-250. - Reserved. 1723 <br /> 1724 <br />DIVISION 2. - LOTS 1725 <br /> 1726 <br />Sec. 82-251. -– Security Performance bond to include lot improvement. 1727 <br />The security performance bond required shall include an amount to guarantee completion of all 1728 <br />requirements contained in this division, including but not limited to erosion control, soil preservation, 1729 <br />final grading, lot drainage, land stabilization, lawn-grass seeding, removal of debris and waste, fencing, 1730 <br />and all other lot improvements required by the city. 1731 <br />Sec. 82-252. - Lot arrangement. 1732 <br />The lot arrangement shall be such that there will be no foreseeable difficulties, for reasons of 1733 <br />topography or other conditions, in securing building permits to build on all lots in compliance with 1734 <br />chapter 78 and in providing driveway access to buildings on such lots from an approved street. 1735 <br />Sec. 82-253. - Lot dimensions. 1736 <br />Lot dimensions shall comply with the minimum standards of chapter 78. Where lots are more than 1737 <br />double the minimum required area for the zoning district, the city may require that such lots be arranged 1738 <br />so as to allow further subdivision and the opening of future streets where they would be necessary to 1739 <br />serve such potential lots, all in compliance with chapter 78. In general, side lot lines shall be at right 1740 <br />angles to street lines (or radial to curving street lines) unless a variation from this rule will give a better 1741 <br />street or lot plan. Dimensions of corner lots shall be large enough to allow for erection of buildings, 1742 <br />observing the minimum front yard setback from both streets. Depth and width of properties reserved or 1743 <br />laid out for business, commercial or industrial purposes shall be adequate to provide for the off -street 1744 <br />parking and loading facilities required for the type of use and development contemplated, as established 1745 <br />in chapter 78. Notwithstanding the required width of each lot, each lot shall maintain a minimum frontage 1746 <br />of 18 feet on a public or private street, or access outlot. 1747 <br />Sec. 82-254. - Lot area, minimum. 1748 <br /> 1749 <br />A. In areas not served by sanitary sewer, each lot must contain a minimum of two acres of 1750 <br />contiguous Dry Buildable Land exclusive of public rights-of-way, vehicular easements, or areas 1751 <br />at or below the floodplain elevation for a specific property. 1752 <br />B. In areas served by sanitary sewer, each lot must contain contiguous Dry Buildable Land equal to 1753 <br />the minimum areas as prescribed in chapter 78 or half -acre, whichever is less (exclusive of public rights-1754 <br />of-way, vehicular easements, or areas at or below the floodplain elevation for a specific property), and 1755 <br />have legal access to the building site without encroachment of a wetland or floodplain area. 1756 <br /> C. Outlots. Outlots are not intended for development except for the purpose in which they are 1757 <br />created, which may include streets, stormwater management, monument signs, etc. Outlots intended for 1758 <br />future development shall not be subject to development fees until they are platted as buildable lots. 1759 <br /> 1760 <br />The minimum area requirements for each proposed lot as prescribed in chapter 78. The lot area must 1761 <br />also comply with chapter 58, article II. Public and private rights-of-way, vehicular or pedestrian 1762 <br />easements, or surface areas below the ordinary high water mark of any surface water or wetlands or 1763 <br />floodplain areas may not be used in order to meet any portion of the minimum lot area requiremen ts. 1764 <br />Sec. 82-255. - Lakeshore lots. 1765 <br />Commented [JB102]: This is a new minimum, and <br />provides for a minimum width of driveway and drive <br />setbacks for snow storage, etc. <br />Commented [JB104]: Commissioner Bollis does not <br />support a minimum. <br />Commented [JB103]: The Planning Commission <br />discussed this proposed requirement at length during their <br />review on July 20th. Commissioners Ressler and Bollis did <br />not want to include it, while the balance of Commissioners <br />wanted to keep it. Staff recommends the clause to provide <br />further clarity to the lot design process. <br />Commented [JB105]: Zoning: Lot area means the area <br />of a lot in a horizontal plane bounded by the lot lines, <br />but not including any area occupied by the waters of a <br />duly recorded lake or river or wetland or area which <br />has been dedicated as public right -of-way. <br /> <br />Commented [JB106]: Necessary?
