July 20, 2020 page 8 <br />Sec. 82-4. - Policy. 288 <br />(a) It is the policy of the city to consider the subdivision of land and the subsequent development of 289 <br />subdivided land as subject to the control of the city pursuant to the official comprehensive municipal 290 <br />planCommunity Management Plan of the city and this chapter for the orderly, planned, efficient and 291 <br />economical development of the city. 292 <br />(b) Land to be subdivided shall be of such character that it can be used safely for building purposes 293 <br />without danger to health or peril from fire, flood or other menace. Land shall not be subdivided until 294 <br />available adequate public and private facilities and improvements exist and proper provision has been 295 <br />made for drainage, water, sewerage and capital improvements, such as schools, parks, recreation 296 <br />facilities, transportation facilities and other public improvements. 297 <br />(c) The existing and proposed public and private improvements shall conform to and be properly related 298 <br />to the proposals shown in the comprehensive municipal planCommunity Management Plan of the city, 299 <br />and it is intended that this chapter shall supplement and facilitate the enforcement of the provisions 300 <br />and standards contained in the official controls and comprehensive municipal planCommunity 301 <br />Management Plan of the city. 302 <br />Sec. 82-5. - Purposes. 303 <br />This chapter is adopted for the following purposes: 304 <br />(1) To protect and provide for the public health, safety and general welfare of the city and to prevent 305 <br />harm to the public health, safety and general welfare. 306 <br />(2) To guide the future growth and development of the city in accordance with the comprehensive 307 <br />municipal planCommunity Management Plan. 308 <br />(3) To provide for adequate light, air and privacy; to secure safety from fire, flood and other danger; 309 <br />and to prevent overcrowding of the land and undue congestion of population. 310 <br />(4) To protect the character of the land to be divided as well as the surrounding lands and the social 311 <br />and economic stability of all parts of the city and to encourage the orderly and beneficial 312 <br />development of all parts of the city. 313 <br />(5) To protect and conserve the value of land throughout the city and the value of structures and 314 <br />other improvements upon the land, and to minimize the conflicts among the uses of land. 315 <br />(6) To guide public and private policy and action in order to provide adequate and efficient 316 <br />transportation, water, sewerage, schools, parks, playgrounds, recreation and other public 317 <br />requirements and facilities. 318 <br />(7) To provide the most beneficial relationship between the uses of land and buildings and the 319 <br />circulation of traffic throughout the city, having particular regard to the avoidance of congestion 320 <br />in the streets and highways, and the pedestrian traffic movements appropriate to the various uses 321 <br />of land and buildings, and to provide for the proper location and width of streets and building 322 <br />lines. 323 <br />(8) To establish reasonable standards of design and procedures for subdivisions and resubdivisions, 324 <br />in order to further the orderly layout and use of land; and to ensure proper legal descriptions and 325 <br />monumenting of subdivided land. 326 <br />(9) To ensure that public and private facilities are available and will have a sufficient capacity to 327 <br />serve the proposed subdivision. 328 <br />(10) To prevent the pollution of air, streams, ponds, wetlands, Lake Minnetonka and other bodies 329 <br />of water; to provide reasonable access to public waters; to assure the adequacy of drainage 330 <br />facilities; to safeguard the water table; and to encourage the wise use and management of natural 331 <br />Commented [SM19]: See previous comment. <br />Commented [JB20]: Adjusted the definition. <br />Commented [JB21]: Find and delete
