<br />instrument. Lease of land for agricultural purposes, which land does not include the use of or future 209
<br />construction of a building, is excluded. 210
<br />Setback means the minimum horizontal distance between a structure, system or facility and a natural 211
<br />feature, property line, right-of-way line, ordinary high water level, structure, system or other facility. 212
<br />Sewage treatment system, on-site, means a device or series of interconnected components designed, 213
<br />installed and maintained for the purpose of safely treating and disposing of sewage and domestic waste, 214
<br />whenever such system is not part of a municipal sewerage system. 215
<br />(1) Individual system means a system serving an individual building, typically a single-family 216
<br />residence. 217
<br />(2) Collective system means a system serving two or more buildings, typically including individual 218
<br />septic tanks connected to a common soil treatment and absorption area. 219
<br />(3) Commercial system means a system serving any nonresidential building. 220
<br />Screening means a manmade or natural visual barrier of a type that will form a year-round dense 221
<br />screen. 222
<br />Shade tree means a tree of approved species and size. 223
<br />Shoreline means a line denoting the ordinary high water elevation of any lake, stream or other b ody 224
<br />of water, which ordinary high water elevation shall be as established by the Minnehaha Creek Watershed 225
<br />District, department of natural resources, or any other agency, whichever elevation is the highest. 226
<br />Single ownership means ownership by the same person, corporation, firm, entity, partnership or 227
<br />unincorporated association; or ownership by different corporations, firms, partnerships, entities or 228
<br />unincorporated associations, in which a stockholder, partner, or associate, or a member of his their family 229
<br />owns an interest in each corporation, firm, partnership, entity or unincorporated association. 230
<br />Slope means vertical distance in feet per 100 feet of horizontal distance. 231
<br />State means the State of Minnesota 232
<br />Street means the same as Roadways. 233
<br />Structure means anything which is built, constructed or erected, an edifice or building of any kind, or 234
<br />any piece of work artificially built up or composed of parts joined together in some definite manner, 235
<br />which requires a location on, below or above the ground, land or water, or attached to something having a 236
<br />location on the ground, land or water. 237
<br />Subdivider means any person who: 238
<br />(1) Has an interest in land, who causes it, directly or indirectly to be divided into a subdivision; 239
<br />(2) Directly or indirectly sells, leases or develops, or advertises for sale, lease or development, any 240
<br />interest, lot, parcel, site, unit or plot in a subdivision; 241
<br />(3) Engages directly or through an agent in the business of selling, leasing, developing or offering 242
<br />for sale, lease or development a subdivision or any interest, lot, parcel, site, unit or plot in a 243
<br />subdivision; or 244
<br />(4) Is directly or indirectly controlled by or under direct or indirect common control with any of the 245
<br />foregoing. 246
<br />Subdivider's agent means any person who represents or acts for or on behalf of a subdivider in 247
<br />selling, leasing or developing, or offering to sell, lease or develop, any interest, lot, parcel, unit, site or 248
<br />plot in a subdivision. 249
