<br /> <br /> <br />To: Chair Ressler and Planning Commission Members <br /> Dustin Rief, City Administrator <br /> <br />From: Jeremy Barnhart, AICP <br /> Community Development Director <br /> <br />Date: June 15, 2020 <br /> <br />Subject: #LA19-65, City of Orono Text Amendment Subdivision Ordinance <br /> <br /> <br /> <br />Background <br />In order to clarify, streamline, and adjust the subdivision process to be consistent with state law, <br />subdivision patterns and Council goals; staff, including the city attorney, have reviewed the <br />subdivision code and proposed deletions and additions as appropriate. All changes are shown. <br />Also, commentary by the city attorney and staff is included, to aid in understanding of the <br />changes. <br /> <br />Main areas of focus include: <br /> Coordinate definitions between the zoning ordinance and the subdivision code <br /> Remove unnecessarily unique terms (Flexible Zoning) <br /> Consolidate references to Comprehensive Plan (Community Management Plan) <br /> Remove unnecessary or redundant regulations <br /> Remove unnecessary Classifications of subdivision, they all have essentially the same <br />process. <br /> Clarify the issuance of building permits post subdivision <br /> Clarified the review process <br /> Clarify the distinction between a subdivision and a plat. A subdivision is the act of <br />splitting a parcel into 2 or more parcels. A plat is the document that illustrates those <br />changes. <br /> Establish a time period in which to record a final plat, 1 year. <br /> Requires all subdivisions to be platted. (Section 82-111) <br /> Limit boundary line adjustments to one per year, to allow the County to keep up with <br />the changes. (Section 82-200) <br /> Revise security requirements, removed references to bond in favor of other security. <br />Usually this is a letter of credit. (Section 82-213) <br /> Lowered the security to be more in-line with industry standards (Section 82-213) <br /> Removed the different requirements for non-residential subdivisions. (Section 82-217) <br /> Clarified required lot area (Section 82-254). This represents no change to how we apply <br />the regulation. <br /> Define flag lots (Section 82-256) which have been prohibited but not defined. <br /> Added design criteria for cul de sacs. This is in addition to existing ROW width and <br />Application Summary: The City is developing revisions to the subdivision ordinance. <br />Staff Recommendation: Staff recommends approval of the ordinance as drafted.
