�O.ATO CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> )01111L,4 c- <br /> NO. <br /> 7127 <br /> k <br /> A RESOLUTION DISPENSING WITH STATUTORY <br /> REQUIREMENTS FOR REVIEW BY PLANNING <br /> COMMISSION OF ACQUISITION OF PROPERTY AND <br /> APPROVING ACQUISITION OF PROPERTY FROM THE <br /> MINNESOTA DEPARTMENT OF TRANSPORTATION <br /> WHEREAS, the Minnesota Department of Transportation ("MnDOT") is the fee owner of <br /> 5.85 acres of vacant land in the City of Orono legally described in Exhibit A attached hereto which it <br /> has advertised for immediate purchase under the terms identified on its web site: <br /> http://www.dot.state.mn.us/row/propsales.html ("Proposal"); <br /> WHEREAS, the City of Orono has completed an environmental and title review of the <br /> Property and is satisfied with the results of the review' <br /> WHEREAS, the City of Orono desires to purchase the Property from MnDOT for <br /> $340,000.00; and <br /> WHEREAS, Minn. Stat. §462.356, subd. 2 requires that the Planning Commission review <br /> the City's proposed acquisition of real property for compliance with the comprehensive plan and to <br /> report to the City Council in writing its findings; and <br /> WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the requirement <br /> for review by the Planning Commission upon 2/3 vote of the City Council dispensing with the <br /> requirement and finding that the acquisition or disposal of the real property has no relationship to the <br /> comprehensive municipal plan. <br /> NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Orono: <br /> 1. City Council finds that the acquisition of the Property under the Purchase Agreement <br /> has no relationship to the comprehensive plan. <br /> 2. Review by the Planning Commission of the acquisition of the Property is hereby <br /> dispensed with, the proposed transaction is hereby approved and the Mayor and City Clerk are <br /> authorized and directed to execute all documents, and take all appropriate measures to acquire the <br /> Property pursuant to the terms of the MnDOT Proposal. <br />
