PRACTICAL DIFFICULTIES DOCUMENTATION FORM <br /> LA20-000057 <br /> he property owner proposes to use the property in a reasonable manner not permitted by <br /> Zoning Chapter. <br /> Response: The property owners proposed variance would allow a garage to be closer to Fagerness Point <br /> Road than the current Zoning Chapter allows. The garage would still be much farther off the street than <br /> most homes garages. <br /> 2. The plight of the landowner is due to circumstances unique to his property not created by the <br /> landowner. <br /> Response: The landowner removed a garage that was very close to Fagerness Point Road in 2009 and built <br /> a custom home that was compliant to the regulations at that time. We are proposing a this garage addition <br /> bring the property back to a consistent design to the neighboring properties. <br /> 3. The variance, if granted, will not alter the essential character of the locality. <br /> Response: If the variance is granted it will enhance the character of the locality. The home will be more <br /> consistent with the design of the other properties on Fagerness Point Road. <br /> 4. Economic considerations alone do not constitute practical difficulties if reasonable use for <br /> the property exists under the terms of the Zoning Chapter. <br /> Response: Economic considerations are not part of our proposed application <br /> ractical difficulties include, but are not limited to, inadequate access to direct sunlight for <br /> solar energy systems. Variances shall be granted for earth-sheltered construction as defined in <br /> Minnesota Statutes, Section 116106, Subd. 2, when in harmony with this Chapter. <br /> Response: The property owners recently purchased a Tesla electric car. They are currently checking into <br /> solar options that would work on the proposed roof of the screen porch. <br /> 6. The Board of Appeals and Adjustments or the Council may not permit as a variance any use <br /> that is not allowed under this Chapter for property in the zone where the affected person's land <br /> is located. <br /> Response: The property owner is not proposing and anything that is not allowed under the zoning of the <br /> property. <br /> 7. The Board or Council may permit as a variance the temporary use of a one-family dwelling as <br /> a two-family dwelling. <br /> Response: NA <br /> 8. The special conditions applying to the structure or land in question are peculiar to such <br /> property or immediately adjoining property. <br /> Response: The current design of the home is a little odd or unusual compared to the neighboring <br /> erties. The home has a more straight up design to fit on the lot within the conforming regulation. The <br /> ge expansion and screened in area will better match the existing, and under construction homes on <br /> Fagerness Point Road <br /> 9. The conditions do not apply generally to other land or structures in the district in which said <br />
