telmLiLLOAle.‘ CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> s1G,� NO. 7109 <br /> `•KES H <br /> A RESOLUTION <br /> APPROVING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1700 <br /> FILE NO.LA20-000039 <br /> WHEREAS, on May 22, 2020, Sherry and John Gorman ("Applicants"), applied for a <br /> variance from the City Code for the property addressed 3585 Frederick Street and legally described as: <br /> Lot 5,Block 1,Tilison's Villa Carman,Hennepin County, Minnesota.Abstract Property. <br /> All that part of Lot 14, Block 2, "Navarre",Hennepin County,Minnesota lying westerly and southerly <br /> of the following described line:Commencing at the northeast corner of Lot 13,said Block 2,"Navarre", <br /> thence South 89 degrees 32 minutes 53 seconds West along the north line of Lots 13 and 14,a distance <br /> of 100.10 feet to the northwest corner of said Lot 14 and the point of beginning of said line to be <br /> described;thence South 01 degrees 38 minutes 00 seconds East a distance of 279.5 feet more or less <br /> to the shoreline of Lake Minnetonka and said line there terminating.Torrens Property(hereinafter the <br /> "Property"); <br /> WHEREAS,the Applicants have made application to the City of Orono for a variance to <br /> Orono Municipal Zoning Code Section 78-1700 to allow hardcover to exceed 25%to 29.62%; and <br /> WHEREAS, on June 15, 2020, after published and mailed notice in accordance with <br /> Minnesota Statutes and the City Code, the City Council held a public hearing, at which time all persons <br /> desiring to be heard concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, on June 15, 2020, the Planning Commission recommended approval of the <br /> variance; and <br /> WHEREAS, on July 13, 2020, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the requested variance as described above based on one or more of the following findings <br /> of fact concerning the Property: <br /> FINDINGS OF FACT: <br /> 1. This application was reviewed as Zoning File# LA20-00039. The analysis contained within staff <br /> memos and the exhibits attached to the aforesaid memos, all minutes from the above mentioned <br /> 1 <br />
