♦ . <br /> .c1/4) 0 4, <br /> O O <br /> z <br /> =� ; �� CITY of ORONO <br /> vs, &, <br /> i;A 0ti RESOLUTION OF THE CITY COUNCIL <br /> 1 ) + N0. 3166 <br /> A RESOLUTION DETERMINING THAT SANITARY SEWER SERVICE <br /> WILL NOT BE PROVIDED TO VACANT PROPERTY LOCATED AT 11235" TONKA AVENUE <br /> KNOWN AS LOTS 3 AND 4, BLOCK 3, <br /> BAYSIDE ADDITION TO LAKE MINNETONKA <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; <br /> and <br /> WHEREAS, the Stubbs Bay Sewer Project was initiated by <br /> the City to solve existing on-site sewage treatment problems in <br /> the Stubbs Bay area, within which Lots 3 and 4, Block 3, Bayside <br /> Addition to Lake Minnetonka, are located; and <br /> WHEREAS, the aforementioned Lots 3 and 4 are separate <br /> adjacent tax parcels owned in common by a single owner, being <br /> described for tax record purposes as PINS number 05-117-23 13 <br /> 0024 and 05-117-23 13 0025, respectively; and <br /> WHEREAS, the adjacent Lots 5 and 6, Block 3, Bayside <br /> Addition to Lake Minnetonka, are vacant lots which are intended <br /> to be served by municipal sewer; and <br /> WHEREAS, the total dry land area of Lots 3 and 4 is <br /> approximately 0.29 acres , as compared to the existing zoning <br /> regulations requiring 2. 0 acres per buildable site; and <br /> WHEREAS, said parcel is not buildable without one or <br /> more variances from the existing zoning code; and <br /> WHEREAS, the owner of said Lots 3 and 4 has declared to <br /> Hennepin County that Lots 3 and 4 will be allowed to go tax <br /> forfeit; and <br /> WHEREAS, said tax forfeiture would give the City the <br /> opportunity to allow said Lots, 3 and 4 to be sold to an adjacent <br /> property owner to increase the area of the adjacent property; and <br /> WHEREAS, two of the three properties abutting Lots 3 <br /> and 4 are substandard in area and would become more conforming in <br /> area by incorporating said lots with their existing holdings; and <br /> Page 1 of 2 <br />
