Box 66 <br /> — _=' Orono, MN 55356 Crystal Bay, MN 55323-0066 <br /> 23 April 2010 <br /> Bert Addison <br /> 3382 Bayside Rd <br /> Long Lake, MN 55356 <br /> RE: 305 Tonka Avenue <br /> This letter will attempt to summarize the zoning issues regarding your property, PIN 05-117-23-13-0029, <br /> a.k.a. 305 Tonka Avenue in Orono. According to Hennepin County property records, the property <br /> contains approximately 8,900 square feet in area and has 70 feet in width along Tonka Avenue. This <br /> property is located within the LR-1A zoning district, requiring a minimum of 2.0 acres and 200-feet in <br /> width. Building on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot <br /> area or width standards) will require variance approval by the City Council, and such approval is neither <br /> automatic nor guaranteed but requires that a hardship be demonstrated. <br /> Additionally, all current zoning standards will have to be met by the new principal dwelling including <br /> setbacks, lot coverage by structures, hardcover (impervious surface), height limits, etc. the property line <br /> setback requirements of the LR-1A district are as follows: <br /> • Front yard = 50 feet <br /> • Side yard = 30 feet <br /> • Rear yard = 50 feet <br /> Municipal sewer is available. However, based on the size of the property and the number of variances <br /> necessary to build on the property, the City Council decided to specifically exclude it from the 1992 <br /> Stubbs Bay Sewer project. Resolution 3168 was adopted (attached) which states 305 Tonka Avenue will <br /> be excluded from the sewer project due to the substandard size, or"unbuildable" nature, of the lot. <br /> As with all undeveloped properties, the City will accept an application for variances to develop the <br /> property. The Planning Commission and City Council will review all aspects of the proposal which should <br /> include a property survey, building plans, a grading plan, hardcover calculations, etc and make a <br /> determination as to the feasibility of developing this property. Your application will also include a request <br /> to connect to sanitary sewer. Based on the 2010 Fee Schedule, a City sewer connection fee of <br /> $19,750.00 would be due at the time of the issuance of a building permit. <br /> There is a process and are fees associated with making a variance application.
