4100 0 ,4?* <br /> O <br /> : *AO, CITY of ORONO <br /> j /7 <br /> ; <br /> "+`�' ' � RESOLUTION OF THE CITY COUNCIL <br /> 4 4 . � + NO. 3168 <br /> kESBO <br /> A RESOLUTION DETERMINING THAT SANITARY SEWER SERVICE <br /> WILL NOT BE PROVIDED TO VACANT PROPERTY LOCATED AT <br /> "305" TONKA AVENUE KNOWN AS LOT 1, BLOCK 4, <br /> BAYSIDE ADDITION TO LAKE MINNETONKA <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; <br /> and <br /> WHEREAS, the Stubbs Bay Sewer Project was initiated by <br /> the City to solve existing on-site sewage treatment problems in <br /> the Stubbs Bay area, within which Lot 1, Block 4, Bayside <br /> Addition to Lake Minnetonka, is located; and <br /> WHEREAS, the adjacent half of vacated Hill Street has <br /> been combined for tax purposes with said Lot 4 into a single <br /> parcel legally described as: PINS number 05-117-23 13 0029; Lot <br /> 1, Block 4 including the adjacent half of vacated Hill Street, <br /> Minnetonka Bluffs; and <br /> WHEREAS, said parcel is under single separate ownership <br /> not owned in common with any other adjacent property; and <br /> WHEREAS, all adjacent lots are occupied; and <br /> WHEREAS, said parcel is located in the LR-1A Single <br /> Family Lakeshore Residential Zoning District, requiring 2.0 acres <br /> per buildable site; and <br /> WHEREAS, the total dry land area of the parcel is <br /> approximately 0.20 acres, not meeting the 2.0 acre requirement; <br /> and <br /> WHEREAS, said parcel is not buildable without many <br /> variances from the existing zoning code; and <br /> WHEREAS, construction of a single family residence on <br /> the parcel could not be done according to all zoning performance <br /> standards, and would be contrary to the intent of the Community <br /> Management Plan; and <br /> Page 1 of 2 <br />
