The subdividing of the property is not worsening it at all that he sees, it's just <br /> providing another buildable site on a piece of land and gives it some purpose. Otherwise, like they've <br /> mentioned, it's like the island at Fletcher's. In this case, he said it's even a separate code and at some <br /> point,the City Council said this is different and at some point,the group looked at zoning and zoned this <br /> separately from the peninsula houses. <br /> Walsh noted that was before their time. <br /> Johnson stated the North side is zoned differently. <br /> Mr. Gamble said it is zoned half-acre, so it's a different zoning entirely. <br /> Walsh said part of the catch is that they are not trying to create more lots just to create more lots, and <br /> noted the Council has been pretty hard on following the rules and if it's stuck, it's stuck. He said they <br /> have tried to solve some problems. <br /> Printup said to Johnson's point,the Applicant can still use that calculation to benefit the other side of the <br /> lagoon. <br /> Barnhart replied and said,except that there is the 0-75' zone that will impact what they can do on that <br /> lower portion, so they may allow for more of a calculation of hardcover or they may be constrained by <br /> their proximity to the lake. <br /> Johnson noted the entire property is in variance. <br /> Barnhart said yes,the whole property is in variance. <br /> Printup noted they are used to it. <br /> Walsh said he doesn't think that is the inhibitor,it's just that they're in the starting block that there is a <br /> non-conforming property. <br /> Mr. Gamble said that is not unusual in the sense that the Council has moved property lines and done <br /> things with non-conforming lots to improve both lots,not creating a new one to do that, and this isn't <br /> Page 6 of 13 <br />
