CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-1279 <br />FILE NO. LA20-000028 <br />WHEREAS, on April 22, 2020, David Jacobsen-Gretsch and Wendy Jacobsen- <br />Gretsch (hereinafter the "Applicants"), through their builder, applied for a variance from the City Code <br />for the property addressed 2440 Old Beach Road and legally described as: <br />Lot 2, "Shore Hills" except that part thereof lying Southerly of a line running from a <br />point in the Westerly line of said Lot, distant 24 feet Northerly of the Southwesterly corner <br />thereof to a point in the Southeasterly line of said Lot, distant 263.4 feet Northeasterly of the <br />Southwesterly coroner thereof (hereinafter the "Property"); <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a home <br />addition 10' 2" lakeward of the average lakeshore setback; and <br />WHEREAS, on May 18, 2020, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS, on May 18, 2020, the Planning Commission recommended denial of <br />the variance; and <br />WHEREAS, on June 8, 2020, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />WHEREAS, on June 8, 2020, the City Council voted 5 to 0 to direct preparation of <br />findings for approval of the variance. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested variance as described above based on one or more of the <br />following findings of fact concerning the Property: <br />
