Purpose. This application is regarding average setback and lake setback variances in order to <br />conduct a nearly in-kind rebuild of an accessory building. <br />2. MN§15.99 Application Deadline. The application was received on December 18, 2019 and <br />considered to be complete on December 27th. Therefore the 60 -Day review period expires on <br />February 25, 2020. <br />3. Background/ Summary. The applicant is requesting approvals to support an in-kind <br />replacement of a non -conforming accessory building located 53 feet from the lake. They have <br />requested lake and average lakeshore setback variances in order to expand the envelope of the <br />existing accessory building; the expansion is the result of a floor elevation increase to meet <br />floodplain regulations. <br />The existing roof has a peak; the new building will have a flat roof, and must be elevated <br />approximately 2.4 feet to conform to the Floodplain regulations. This elevation change results <br />in the corners of the flat roof expanding outwards from the sloped portions of the existing roof <br />approximately 1.4 feet. Planning Commission Vote and Comment. On January 21St, the Planning Commission held a <br />public hearing. Following the public hearing the Planning Commission voted 4 to 0 in favor of <br />a motion to approve the requested 75 -foot lake and average lakeshore setback variances for the <br />minimal expansion. <br />5. Public Comment. No comments from the neighbors were received. <br />6. Staff Recommendation.
