Purpose. To consider changes to the city code that allows for the licensing of city land for the <br />installation of private docks by adjacent property owners. <br />2. Background. The City Council at its workshop on October 14th directed staff to prepare an <br />ordinance to allow for the private use of city land for docks, specifically for the 4 lots adjacent to <br />city land on Crystal Bay Road. <br />The draft ordinance was discussed at the City Council meeting on January 13th, though action was <br />tabled to allow the full council to act, as Councilmember Printup was absent. <br />The prepared draft is based on Mound, Big Lake, and Minnetonka Beach regulations and <br />establishes a license available to the adjacent residential lot only. The Council will appoint a <br />dock administrator, expected to be the City Administrator or Community Development Director, <br />who will approve the dock license and administer the program. <br />The draft allows only the owner of a particular lot on Crystal Bay Road to be eligible for a <br />particular dock site (lines 26-30.) If the Council wanted to expand the practice in the future, an <br />ordinance amendment will be necessary. <br />The rental of dock space is prohibited on lines 49-51. The licensee will declare their boat, to <br />avoid having the dock be rented out. For homeowners with visitors, a temporary visiting dockage <br />permit is offered, for up to 21 days per calendar year for visits longer than 48 hours. The city will <br />issue a license plate, to be attached to the dock near Crystal Bay Road. <br />The draft includes certain specifications and incorporates LMCD regulations (Lines 56-65). <br />At the meeting on January 13th, the council directed staff to make the following amendments to <br />the draft: <br />a. Duration. The proposed lease term is 10 years. (Line 99) <br />b. Storage. (Lines 68-69) Docks and dock accessories are to be removed from the dock <br />site between November 1 and April 1. <br />Staff made no other changes to the ordinance, waiting for Council direction. <br />Staff seeks direction on the fees. Mound charges $325/ year, $100/ year for the second boat. Big <br />Lake charges $350.00 per year. Minnetonka Beach charges based on the size of the boat, $300 — <br />$600. Staff recommends $325 per year ($975 per license term) and $100 per second boat, per <br />year ($300 per license term). How does the Council anticipate applying these fees? <br />3. Public Comment. No comments have been received to date, though property owners at Crystal <br />Bay Road are monitoring the ordinance and contacting staff frequently. <br />Prepared By: J.
