<br /> stzeet fraa his property. The Casco Circle Park vas deeded
<br /> to the City of Orono with specific direction that the pazk
<br /> be maintained in a natural state. The park exista today as
<br /> it did when the applicant purchased the property.
<br /> 5. The applicant claims the fence providos to protection �
<br /> for his home and surroundinq improvements fzom vandalism. A
<br /> forty foot lenqth fence alonq the street lot line dces not
<br /> o:fer protection for a residence but may, in fact, serve to
<br /> hide vandals from t'�e view of adjacent neighbors and the
<br /> police.
<br /> 6. A forty foot lenqth fence does not provide aecurity.
<br /> The fence is an inteqral part of the landscapfnq p13n and
<br /> ornamental in function nnd use.
<br /> 7. 2he applicant has been advised that he may trim 2 1/2
<br /> feet off the height of r,he existing fence and mafntain a
<br /> leqal 3 1/2 foot high fence, two fcet ofY tl�e road riqht-ot-
<br /> +��ay but has refused to comply.
<br /> 8. The applicant hns beun adviaed that he may move the
<br /> fence 30 feet from the atreet/rear Iot lina and maintain th6
<br /> f.:nce at the six foot heiqht but he has refused to comply.
<br /> 9. Par Section 10.07, Subdivision 6 of the Municipal Zoning
<br /> Code.
<br /> "Zt is unlawful for any person to hereafter erect oz
<br /> structurally alter a btructure until a bui2ding pazrait
<br /> shall have been issued indicating that the existinq or
<br /> proposed structure and the use of the land comply with
<br /> this Zoning Chapter."
<br /> The applicant's contractor failed to obtain the required
<br /> bu:ldinq permit and as a result was never advised of the
<br /> zoninq standazds for fence constructioa.
<br /> 10. The plight of the a�plicant is due tc cirrumstances
<br /> created by the ap�licant or agents of applicant.
<br /> 11. If variances are granted to oermit a new fence 6 feet
<br /> in hQight, two feat off the road riqht-of-way, such action
<br /> would astablish a negative precedent in the review of
<br /> simiiar applications.
