gOAjO <br /> CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ;$,1<4 tiNo.01L4' 7 08 5 <br /> KESHO <br /> NOW,THEREFORE,BE IT RESOLVED that based on the findings of Resolution No. <br /> 6869,the City Council of the City of Orono does hereby grant Master Development Plan Approval for PUD <br /> No. 17, subject to the following conditions: <br /> 1. General Development Plan Approval is granted subject to conditions established within Resolution <br /> No. 6869. <br /> 2. Upon approval of this resolution,the City Council directs staff to amend the Zoning Map,changing <br /> the zoning designation for the subject parcel from B-6 PUD to RPUD. <br /> 3. Plans shall be substantively as shown on building plans provided as Exhibit A and Site Plans <br /> provided as Exhibit B. <br /> 4. Prior to Issuance of a Building Permit for any permanent improvement on the site, the Owner shall: <br /> a. Execute the Trail and Drainage and Utility Easements. (Exhibit C and D) <br /> b. Execute the Escrow Agreement. (Exhibit E) <br /> c. Execute Restrictive Covenants. (Exhibit F) <br /> d. Pay utility and private recreation fees as enumerated above. <br /> e. Provide a Letter of Credit or other security in the form acceptable to Staff for the amount <br /> approved by the City for the completion of the landscaping as shown on the approved <br /> landscape plan. (Exhibit G) <br /> f. Provide a photometric plan showing no measurable light leaving the site at the property <br /> line. <br /> 5. Any substantive changes shall be recorded as amendments to the recorded copy of the final <br /> development plan. <br /> 6. Signage shall be limited to the following: <br /> a. A maximum of one monument sign 8 feet high,4 square feet of text, 16 square feet in area. <br /> b. Two building wall signs, a maximum of 50 square feet each, located on either the north or <br /> south wall of the structure. Changeable copy of any type is not permitted <br /> 7. Any exterior mechanical units(air conditioning,air exchangers,etc.)shall be placed on the ground <br /> or screened by a wall structure. Those placed on the ground shall be screened with fencing and <br /> landscaping, their location approved by staff. An electrical transformer, should one be installed, <br /> will need to be screened/softened with landscaping, approved by staff. <br /> 8. The approvals granted by this resolution runs with the Property not with the Applicants, but are <br /> permissive only and must be exercised by obtaining a building permit for the new construction and <br /> commencing construction of said project.
