On Monday, I reviewed the information you emailed. Based on this review, <br /> we have a number of concerns. <br /> It appears, based on a 2010 wetland delineation (attached image), your grading project filled in wetlands on your <br /> property, in violation of both City of Orono and MCWD regulations. You have not received a permit to perform grading <br /> operations; the"permit"you forwarded from the MCWD is an application for an erosion control permit. <br /> We require permits and specific information for grading projects to avoid costly mitigation and corrective action. Had you <br /> submitted the required information and received a permit prior to conducting the work in December, you may have <br /> avoided unnecessary time and expense. A new wetland delineation should be conducted and submitted to the MCWD for <br /> approval prior to the City and the MCWD approving any permits for filling/grading in the general areas you propose. At <br /> this time the fill placed on the property must be removed. <br /> A permit application must include: <br /> • Wetland delineation <br /> • Existing topography of the property; <br /> • Proposed grading, proposed topography; <br /> • Current wetland delineation areas shown; <br /> • Quantities of fill material. <br /> Once the filled areas are restored and the City has the information requested we can review your proposal. Please note, <br /> the MCWD generally does not allow fill in wetlands for any reason that could be considered"esthetic"or just because the <br /> yard is wet. <br /> The fill must be removed and the areas re-graded and re-seeded by or before June 22nd. Failure to respond as <br /> requested by June 22, 2017 will result in this matter being forwarded to the City Attorney for prosecution and/or issuance <br /> of a citation. <br /> Please contact me if you have any questions.
