You came to our home and verbally contracted our <br /> services to install and maintain your docks. <br /> 2) We preformed all labor and service in a timely and satisfactory manner, per your request. <br /> 3) We have requested payment for goods and services rendered. We have never threatened you <br /> in any way. We have been repeatedly lied to in regards to payment. <br /> 4) We never vandalized your mailbox, your accusations are false and slanderous. <br /> 5) We never subcontracted work on your Eklof dock in the 2003 season. We referred you to <br /> Darryl Johnson and you contacted him. After this separate transaction with Darryl, you once <br /> again contacted us to relocate it to the lagoon. Payment for this separate service was received <br /> from you, you did not pay for the same service twice. <br /> 6) We have not lured you into spending money. In regards to the bumpers, you were offered <br /> used bumpers on May 8, 2004, at the cost of$30, however, you chose to pass on them at that <br /> time. In June, when you realized you needed protection for your renters' boats-so they could not <br /> sue you for damages, and cut into your profits-there were no used bumpers available. Even an <br /> illegal marina will require parts and services. <br /> 7) In regards to the raising of your dock, this season Lake Minnetonka rose 24" between May 11 <br /> and June 11. We informed you of the possibility of the loss of decking due to large wakes from <br /> the high volume of boat traffic from the Narrows Channel. You were also informed that if wooden <br /> dock sections were allowed to stand in the water, you would loose your decking warranty. We told <br /> you the cost of raising your dock would be comparable to the cost of replacing one deck. It was <br /> your decision to make, and upon your instruction, we raised your dock to protect your potential <br /> investment. <br /> 8) We repeatedly informed you that your plans to rent boat slips for profit was against the law. <br /> We offered you copies of the City of Orono and the LMCD regulations regarding docks, as did <br /> Crepeau Docks. You refused our verbal and printed information on this issue. We did not install <br /> an illegal dock. Your rental of eight boat slips at 2740 Shadywood Road was the illegal act. You <br /> did so with full knowledge and disregard of the law. Your blatant disregard of the law, and <br /> certified letters ordering removal of the illegally docked boats, was your choice. <br /> 9) You have repeatedly shown bad faith in regards to payment for both goods and services.
