Elaine Pagonis
Court File No. MC 04-14830
Our File No. 754868
Dear Michael:
Please find enclosed the executed Amended Order Granting Default Judgment. As you
will recall, I was dissatisfied with Judge Crump's original Order Granting Default Judgment and
approached the Court for necessary additional relief By signing the Amended Order, Judge
Crump found that Pagonis violated the City of Orono's Ordinances through her conduct and a
permanent injunction is now in place preventing her from engaging in the business of docking,
mooring or storing boats at her property.
As noted in my previous correspondence, Ms. Pagonis can choose to cure her default in
this action and contest the City's position through the Court. However, in order to do so, Ms.
Pagonis will have to comply with the Minnesota Rules of Civil Procedure, file a formal motion,
and pay the sanctions of $480 which have now been imposed against her. I will keep you
advised if any such developments occur. Please feel free to contact me directly should you have
any questions. Thank you for the opportunity to assist you in this regard.
Very truly yours,
Mark T.
