We have not received an after-the-fact building permit application nor updated survey as <br /> required to resolve this matter. In good faith, I contacted you by telephone on January 10, 2014, May 2, <br /> 2014, May 21, 2014 and August 5, 2014. All of those times resulted in a verbal commitment from you to <br /> follow through with the requirements of the December 10th violation letter. To date we have not received <br /> the required information. Your property remains in violation of City Code Section 86-66. <br /> This letter will serve as your final notice that the property must be brought into compliance <br /> before,Wednesday, October 29, 2014. In order to bring the property into compliance the porch must be <br /> removed or a complete after-the-fact building permit submitted, with all the necessary requirements, <br /> including an updated survey meeting all of the City's survey requirements and specifically indicating the <br /> average lakeshore setback line. Please be aware, if the porch encroaches into the average lakeshore <br /> setback, staff will be unable to approve it administratively and City Council approval of an after-the-fact <br /> variance will be necessary or the structure removed. <br /> If you are interested in applying for an after-the-fact building permit, the City's Building Permit Application <br /> packet is enclosed. Building permit fees are based on estimated construction value. After-the-fact <br /> variances and permits are subject to double the permit fees. <br /> Please be advised if you fail to comply with this notice,this matter will be sent to the City Attorney <br /> for Review and may result in criminal prosecution. I have attached the pertinent City Code for your <br /> reference.
