MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, April 13, 2020 <br />6:03 o'clock p.m. <br />Johnson said the City pledged $80,000 and the first question that needs to be answered is, does the City <br />want to pledge more money. <br />Walsh indicated that Johnson was correct and stated that is the difference between B and C. Option C is <br />an extra $10,000 and Option B is an extra $50,000 which still leaves $30,000 on the grant available for <br />the 501(c)(3) to gather. Option B includes the toilet; Option C does not include the toilet. <br />Crosby suggested Option B and said the City should take Edwards' recommendation on the bathroom <br />location and keep the trails. He said more could be done later. <br />Rief expressed concern about placing the toilet away from the Visitor Center and the jurisdiction the City <br />does not have when it relates to being in the natural area. He said if there is a hose being run up the hill <br />from the Visitor Center and the hose breaks, the liability would be the same but the hose would be three <br />times as long. Jurisdiction is quite a bit different in the natural area versus the recreational area. He also <br />leans on Edwards' recommendation from a maintenance point of view. <br />Seals moved, Crosby seconded, to go with Option B, putting the vault toilet by the Visitor Center <br />per the City Engineer's recommendation for the Big Island Park ADA Trail Project (19-033). <br />Johnson noted if the toilet is located by the Visitor Center, it will be utilized more. <br />VOTE: Ayes 4 (Johnson, Crosby, Seals, Walsh), Nays 1 (Printup). <br />Walsh moved, Crosby seconded, to award the Big Island Park ADA Trail Project to Blackstone <br />Contracting, accept the construction management fee proposal from Bolton & Menk not to exceed <br />$20,000, authorize payment of $1,177 in design fees above the previous not -to -exceed proposal, and <br />accept the in -kind donation of $10,000 from Bolton & Menk. VOTE: Ayes 5 (Johnson, Crosby, <br />Seals, Printup, Walsh), Nays 0. <br />PLANNING DEPARTMENT REPORT <br />15. LA20-000016 — PAUL THOMAS DESIGN BUILD, 2710 PENCE LANE, CONDITIONAL <br />USE PERMIT <br />Staff presented a summary of packet information. <br />Johnson noted they have had this same type of request that they have granted to people, and it's been <br />fairly rubber-stamped as long as the people agree to the conditions. He asked Mattick if there is a reason <br />for the City not to grant a Conditional Use Permit (CUP) in the meantime when there are ongoing, <br />existing, and historical violations on a property. <br />Mattick asked Johnson if he was referring to the alleged violation on the shoreline. <br />Johnson said he understands that issue is open and that there were other issues with the use of the <br />driveway, etc. <br />Page 12 of 25 <br />
