0 CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y <br /> NO. 7 0 8 4 <br /> F G - - - - <br /> lgkESHO�� <br /> A RESOLUTION AMENDING <br /> RESOLUTION NO. 7030 <br /> GRANTING AN AVERAGE LAKESHORE <br /> SETBACK VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1279 <br /> FILE NO. LA19-000071 <br /> WHEREAS, Martha Myers Head is the Trustee of the Martha M. Head 2014 <br /> Qualified Personal Residence Trust(hereinafter the "Applicant") the owner of the property located <br /> at 2090 Shoreline Drive and legally described in Exhibit A, attached (hereinafter the "Property"); <br /> WHEREAS, on October 14, 2019, the City Council approved Resolution No. 7030 <br /> which granted average lake setback variances to allow construction of home additions lakeward <br /> of the average lakeshore setback; <br /> WHEREAS, the Applicants have requested an amendment to Resolution No. 7030 <br /> to allow modifications to the proposed plans whch in most places reduce the encroachments; and <br /> in some portions increase or change the areas of encroachment according to the attached revised <br /> Exhibit C; and <br /> WHEREAS, The City Council reviewed this application on April 13, 2020, and <br /> voted to approve the amended plans for average lakeshore setback to permit the additions and <br /> modifications to the home according to the revised plans attached as Exhibits B & C. <br /> WHEREAS, the City Council's decision was based on the following findings and <br /> recommendations of the Planning Commission, reports by City staff, comments by the Applicants <br /> and the public, and the effect of the proposed variances on the health, safety and welfare of the <br /> community as well as the impact on properties in the vicinity. <br /> FINDINGS OF FACT: <br /> 1. This application was reviewed as Zoning File #LA19-000071. The analysis contained <br /> within staff memos and the exhibits attached to the aforesaid memos, all minutes from the <br /> above mentioned meetings, and any and all other materials distributed at these meetings <br /> are hereby incorporated by reference. <br /> 2. The Property is located in the LR-1A Lakeshore Residential Zoning District. <br /> 3. The Property contains 3.76 acres in area. <br /> I <br />
