MINU'I'ES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday, October 10, 2005 _ <br /> 7:00 o'clock p.m. <br /> (#OS-3121. Narror��s Saloon, Continued) <br /> �arking lot but within the applicant's properly, measuring 837 square feet in area or approximately 32 <br /> additional seats. <br /> The Planning Conunission initially reviewed this application and held a puUlic hearing on June 20, 2005, <br /> at which time the application was tabled and the applicants were advised to revise plans. The Planning <br /> Commission suUsequently reviewed a revised plan and held a second hearing on July 18, 2005, at which <br /> time the application was again taUled with the applicant given additional direction to provide further <br /> revisions and to provide a study of the parking situation, <br /> A third hearing before the Planning Cornmission on the application was held on September 19,2005, at <br /> which time the Planning Commission voted 7-0 to recoinmend approval of a conditional use pernlit for <br /> expansion of the saloon subject to the following: <br /> 1. The outside seating area at the rear of building be limitcd to 837 square feet and no more than <br /> 32 seats. <br /> 2. Hours of operation for outside seating: No seating or alcohol to be allowed in outside area after <br /> 10:00 p.m. Sunday through Thursday evenings, 11;00 p.in, on Friday and Saturday evenings. <br /> This area would be open to smolcing only after those hours. <br /> 3. There shall be no amplication or speakers outside the building,nor in the outdoor seating area,to <br /> limit any outdoor noise impacts. <br /> 4. The easterly access door to the outside seating area from the restaurant, shall not be bifold but <br /> shall be a self-closing door to eliminate direct noisehnusic impacts to the ouCside area. <br /> 5. Conditional use permit a�proval shall be sttbject to a speci�c written condition that the use Ue <br /> reviewed after one year of operation. <br /> Gaffron stated the�roperty is zoned B-1 Retail Sales Business Dish-ict, with the proposed expansion of <br /> the existing Class II Restaurant use requiring an amendment of the existing CUP. Gaffi-on noted the <br /> expansion would noi go outside the sh�ucture of the Uuilding except for the outdoor seating area. <br /> Gaffi-on stated the existing restaurant use in this area appears to be consistent rviih the illtent of the <br /> Comprehensive Plan, which is to provide for commercial businesses that serve area residents. Gaffron <br /> stated an issue has been raised during the public hearings whether the use after the proposed expansion <br /> will be consistent�uith the City's policies and �oals. Gaffron read the pertinent policy statements for <br /> consideration by lhe Council. <br /> Gaffi•on indicated the Plamiing Commission did discuss the possiUle regional draw of the entertainment <br /> aspects of the expanded use. Council should consider whether the expansion �nay push the size or <br /> ma��itude of the use beyond the scale that is compatible with the sui-�•oundin�neighborhood.
