Staff wot�ld <br /> note that although the design and l�yout are somewhat Linconventional, the zoning cocle <br /> generally does not address the interior design or aesthetics of a single family residence. It is <br /> fair to note, however, that there is a kitchen or kitchenette on each of the home's tlu•ee levels, <br /> �nd tliat the `studio' above the garage has a high potential fi•om a design standpoint to <br /> become a guest apartment as the studio is separated from the rest of the house by a single <br /> doorway, has a fiill bath and closet in adclition to a kitchenette, and has � seplrate entrance to <br /> the garage. This property would potentially qualify for a guest lpartment CUP if one w�s <br /> applied for; it may be prudent to incorporate language into the resolution advising applicant <br /> that the studio space cannot be used as a separate rental dwelling unit, and would require a <br /> guest apartment CUP if proposed for that use. <br /> Issues for Consideration <br /> 1. Is the proposed house location acceptable, or should it be inoved filrther rearward? <br /> 2. Is the proposecl landscape plan acceptable? <br /> 3. Does Council have any other concerns regarding this application? <br /> Staff Recommendation <br /> Staff recommends approval of the lot width variance. Staff reconunends approval of the <br /> average setback variance, subject to confirmation of a house location that is acceptable to the <br /> Council. <br /> Staff finds that the tluesholds establisl�ed in the Zorung Code for requiring a land alteration <br /> CUP are not surpassed with this proposal, hence no such CUP is required. However, if the <br /> house is required to be relocated, a revised grading plan should be required to confirm that <br /> the 500 c.y. grading tlireshold is not sui•passed and that building 1�eigllt does not become an <br /> issue. <br /> Cotulcil should review the landscape plan with tl�e affected neighbors to determine whether <br /> they find it satisfactory. <br /> Council should determine whether an �dvisoiy regarding rental use of the studio space is <br /> warranted. <br /> COUNCIL ACTION R�QU�ST�D <br /> Reach conclusions on the above issues aud direct staff to draft an appropriate resolution. <br />
