Municipal Zoning Code Section 78-71 is hereby deleted in its entirety and the � <br /> following language substituted in its place: <br /> "Section 78-71. Non-Conformiug Structures aud Uses. <br /> (a) General Provisions <br /> (1) Putpose. It is the purpose of this Section to regulate nonconfonning <br /> shuctures and uses, and to specify those requirements, circumstances and conditions under <br /> which nonconforming structures and uses will be operated and maintained. The Zoning <br /> Ordinance establishes zoning districts and specific uses which are pennitted within each <br /> district.It is necessary and consistent with the establislunent of these districts that nonconfonning <br /> snuctures and uses not be pei7nitted to continue without restciction. Furthennore,it is the intent <br /> of tlus section fllat all nonconfomvizg uses a�1d shuctures shall be evenhlally brought into confomuty. <br /> (2) Effective Date. Any structure or use lawfitlly existing upon the effective <br /> date of tlus Ordinance shall not be changed, enlarged, expanded, extended, or structurally <br /> altered in any manner which increases its nonconfonnity, but may be continued at the size <br /> and in the mamier of operation existing upon such date except as hereinafter specified or, <br /> subsequently ainended. However, any land or buildings which were actually and legally <br /> devoted to a nonconfornling use oii January l, 1975 and which were thereafter specifically <br /> allowed to continue said nonconfonning use under the tei-�ns of a conditional use pern-�it <br /> issued Uy the City Council, shall be allowed to continue under the tenns of said conditional <br /> use pei-�nit. <br /> (3) Safety Repairs. Nothing in this Zoning Cl�apter shall prevent the placing <br /> of a structure in safe conditiou when said structure is declared unsafe by the Building Official, <br /> providing the necess�uy repairs shall not constihrte more tl�an fiflypercent(50%)of the fair marlcet <br /> value ofsuch stnicture.Said value shall be detenninedbythe CityAssessor.Snuch.tY-e shall inclt�de <br /> such accessoiy features attached to t]Ze structure or located anywhere on the land,such as sigi7s, <br /> inarquees, monuments. <br /> Page 1 of 4 <br />
