MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday,February 13, 2006 <br /> 7:00 o'clock p.m. <br /> (#06-3171 John and Joan Brooks, Continued) <br /> Murphy requested Mr. Floyd confine his remarks speci�cally to the application. Muiphy stated the <br /> Council tried to establish that Mr. Floyd has a working path with the City Attorney and the City <br /> Adminisn-ator to address those other issues and that he does not want to take the time to discuss those <br /> other issues tonight. <br /> Floyd stated in his view those issues could be resolved as a part of this process. <br /> White inquired whether workers could access this site through an access that does not belong to the <br /> neighbor. <br /> Brokl stated it is possible. <br /> White stated access is not an issue tonight. <br /> Floyd stated the comments of the applicant show that the use of this structure will intensify. Floyd stated <br /> the existing structure was grandfathered in in 1983 as a single, low ceiling garage, and was not a <br /> boathouse. Floyd stated the structure was snictly utilized for storage. <br /> White inquired whether Mr. Floyd is opposed to the applicant using this sh-ucture as a recreational space. <br /> Floyd stated the use and the intent of the snucture is being changed. <br /> White inquired whether Mr. Floyd is opposed to the application because of that chanbe. <br /> Floyd stated he is opposed to the expansion of the use. <br /> White stated he understands Mr.Floyd's position that he is opposed to the expansion of the use and <br /> requested that Mr. Floyd go on to the next issue. <br /> Floyd stated there cun-ently are two dwellings on the property and that this would be a third dwelling. <br /> Floyd inquired who would be verifying that the structure is not used as living space. <br /> Sansevere commented that it sounds like Mr. Floyd would be monitoring the situation. Sansevere stated <br /> the City has to trust that the citizens will comply with the City's rules and regulations and that the City is <br /> not capable of policing every property. Sansevere stated the City routinely becomes aware of violations <br /> through notification by neighbors. <br /> Brokl stated the City does have the right to give notice and put the matter on for public review whenever <br /> there are concerns raised regarding condition violations of conditional use pennits. Brokl stated the <br /> building could be red tagged if the building does not meet the conditions of the city. <br /> Murphy inquired what Mr. Floyd is worried about regarding the structure. <br /> PAGE 15 of'25 <br />
