MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday,February 13, 2006 <br /> 7:00 o'clock p.m. <br /> 6. #OS-3147 STEVE AND JANNA SUNDBY, 3587 NORTH SHORE DRIVE—VARIANCE <br /> AND CONDITIONAL USE PERMIT <br /> Steve Sundby, Applicant,was present. <br /> Gaffron stated the applicant is requesting a number of variances to consn-uct a 5' by 8' covered entry to <br /> the existing residence. A portion of the entry will Ue under an existing overhang. The applicant is <br /> requesting a lake setback variance to permit a lake setback of 49 feet from the 929.4' OHWL when 75 <br /> feet is nornlally required and 21 feet cui�ently exists. A hardcover variance is also required to pennit 65 <br /> percent hardcover within the 0-75' zone where 0 percent is normally allowed and 65 percent cun-ently <br /> exists. In addition, the applicant is also requesting a sn-uctural coverage variance to pern�it 28 percent <br /> where 1500 square feet is nonnally allowed and 27 percent currently exists. <br /> On January 17`�', the Planning Commission, on a vote of 3-2,recoinmended approval of setback, <br /> hardcover and lot coverage variances as proposed. The minority opinion was that the solution to the <br /> problem was gutters,not an overhang; and that the City needs to either allow entryway overhangs or quit <br /> granting variances to allow them after a house is built without them. <br /> Sansevere indicated he is in favor of the variances,noting that some of these houses are older and that <br /> there are safety issues that should Ue considered. <br /> Murphy inquired whether the City should consider amending their code to allow for covered entryways. <br /> Gaffron reconunended the City Council consider amending their code to allow for a certain sized covered <br /> entryway. Gaffron stated this issue tends to relate to the older homes. <br /> Murphy moved, Sansevere seconded,to direct Staff to draft an approval resolution for Application <br /> #OS-3147, Steve and Janna Sundby,3587 North Shore Drive, granting of variances to allow <br /> construction of a 5' by 8' covered entry. VOTE: Ayes 4, Nays 0. <br /> 7. #OS-3152 BOHLAND DEVELOPMENT ON BEHALF OF JAMES D.MACKINNON,ET <br /> AL, "3500" WATERTOWN ROAD—PRELIMINARY PRD PLAT APPROVAL—RESOLUTION <br /> NO. 5421 <br /> Steve Bohl, Applicant, was present. <br /> Gaffron noted a revised draft resolution has been distributed tonight, with a few n�inor revisions being <br /> made to the resolution since Friday. Gaffron indicated the revisions are shown in bolded print. On page <br /> three language has been added regarding declaration of covenants, conditions,restrictions and private <br /> roadway easement. The intent of the added language is to make it clear that the future property owners of <br /> the property to the north access to Watertown Road will have access to Watertown Road via the private <br /> road at no cost except for sharing of the maintenance costs of the same private road. <br /> PAGE 7 of 25 <br />
