A RESOLUTION GRANTING <br /> A CONDITIONAL USE PERMIT <br /> FOR 1'LUNiBING IN AN ACCESSORY STRUCTURE <br /> PER MUNICIPAL ZONING CODE <br /> SECTION 78-418, SUBDIVISION (16) <br /> FILE #06-3165 <br /> WHEREAS, Dennis C. Backes, a single person, (hereinafter "the applicant") is <br /> owner of the property located at 2940 Fox Street within the City of Orono (hereinafter "City") <br /> and legally described as: <br /> Lot l, Block 1, Stubbs Farm, Heiulepin County, Minnesota <br /> (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for a conditional use permit per <br /> Municipal Zoning Code Section 78-418, Subdivision (16) to allow installation of plumbing <br /> including a toilet, bathroom sink and shower in an accessory structure; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plaluling <br /> Coirunission held a public hearing on January 17, 2006, at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#06-3165. <br /> 2. The property is located in the RR-1B Zoning District, where 2 acres is the <br /> minimtun lot area. The property is approaimately 4.95 acres in area. <br /> 3. The Plaruling Commission reviewed this application on January 17, 2006 and on a <br /> vote of 5-0 recommended approvll of a CUP for plumbing in the accessory <br /> structtue, based on the following fii�dings: <br /> a. The proposed use of the accessory structure with plumbing will not be <br /> detrimental to the residential character of the neighborhood. <br /> Page 1 of 5 <br />
