'`'� 1-���'�.� <br /> ` �-l��� �7,h=r � " <br /> ���Q���'�'� p�� �. <br /> ��.,,.,o c�t c,�q/�l���wn�.:r�r,�-a, <br /> AGREEMENT <br /> This is an Agaement between�the City of Long Lake,Mimlesota(Long Lake) and the <br /> City of Orono, Minnesota(Orono), collectively called the Parties(the Parties), on certain matters <br /> with respect to the joint development of a fire station situated within the City of Orono. <br /> WHE�2EAS, the Parties have entered into a previous Agreement on August 8, 2001 <br /> (Settlement Agreement}for the joint construction, ownership and operation of a new fire station; <br /> and <br /> WHEREAS,pursuant to the Agreement of August 8, 2001, the Parties have agreed to <br /> purchase property in Orono for the new fire station site. The fire station site is a portion of a <br /> larger parcel legally described as Lot 1, Block 1, Willowfire Addition (the "Parcel"); and <br /> WHEREAS, certain matters have arisen with respect to the development of this Parcel <br /> which the Parties desire to resolve and memorialize as an enforceable Agreement; <br /> NOW, THEREFORE,Long Lake and Orono, for good and valuable consideration, <br /> receipt of which is mutually aclrnowledged, do agree as follows: <br /> 1. The Parties agree that the Parcel will be served by a public raad which will • <br /> provide access to the fire station and to the outlot created to the east of the fire station. The <br /> public road is shown on the attached Exhibit A. The construction c�st of this road wi11 be funded <br /> from the joint fire station account, as created by the Agreement of August 8, 2001. The �re <br /> station account will be reimbursed for SO%of the construction cost of the road,plus interest at <br /> the annual rate of 4%, when the outlot to the east of the fire station is develaped. <br /> 2. The Minnesota Deparkment of Transportation has agreed to pay the full cost of <br /> providing a sewer line to seive the fire station. The sewer will cross the Parce3 approximately as <br /> shown on Exhibit A. The Parties agree that the sewer luie may be built to specifications which <br /> provide for �•eater sewer line depth than the sewer Iine for which the Mimiesota Department of <br /> Transportation has agreed to pay. The Parties estimate the additional expense of the deeper <br /> sewer line to be approximately$70,000.00. Orono agrees to pay the additional cosfs. <br /> 3.
