AGENDA ITEM <br />Item No.: 5 <br />Date: January 27, 2020 <br />Item Description: Authorization to Update City Code Relative to Appeals <br />Presenter: Dustin Rief, City Administrator Agenda Consent Agenda <br />Section: <br />1. Purpose. To authorize staff to prepare an ordinance to establish a time -limit to appeal city <br />council decisions. <br />2. Background/ Council Vote. The City Attorney's office suggests the City address time -limits <br />relative to appeals of city decision, as illustrated in the attached memo. They suggest that the <br />City establish a deadline in which a party may file an appeal with the Court. <br />City Code currently limits an appeal of an administrative decision to 10 days, but does not limit <br />an appeal of a city council decision. <br />3. Staff Recommendation. Staff seeks authorization. A recommended ordinance will be prepared <br />and routed through the appropriate review process for consideration. <br />COUNCIL ACTION REQUESTED <br />City Council should authorize staff to prepare the ordinance with guidance from the Attorneys Office. <br />Exhibits <br />A.
