I have given you my ideas as an LMCD board member and also as a resident and now that I <br />know how askew the LMCD is in granting variances for things that neighboring property owners are <br />impacted on... and as always, you can just tell me to pack SAND... I understand that) i! <br />To Dustin Reif, Mayor Walsh and all city council members... <br />Have read with interest the new ideas of docks for the Crystal Bay residents on city property... <br />I still support the concept of a single multiple dock, that was brought up during the work session I <br />attended and if as presented, I would make the case at the LMCD to approve a multiple dock license for <br />the property owners... It would be presented the way the city wants it and bingo, we go on in <br />perpetuity until they break the rules... That way, it's in the LMCD's hands and they can process as you all <br />intend in 38-905 A. <br />**As noted in my past correspondence with you all, there is an issue with a dock that the LMCD granted <br />a variance for in Minnetonka Beach that is only 5' off of the property line on one side of fire lane and <br />zero side setback on the other side... Not only that, they also got a variance for an extension to the 5' <br />navigable water code request and that dock is 158' out from shore... Strongly impacting the enjoyment <br />on the North Property owner... Obviously, you can make the argument that the owner knew what he <br />was buying, but look at the overage of dock #10 (if you do the math the right angle footage is 30')... <br />So, the battle begins as to who is correct; LMCD, City of Mtka Beach, or the resident... <br />So, if left up to the LMCD and they grant similar variances, after all they might say they have jurisdiction <br />at the 929.4 Ordinary high water mark... <br />Subd.38-902 <br />D. Boat license number of any boats to be moored at the dock. LMCD allows up to 4... <br />Subd. 38-905 <br />A. In addition to the provisions of this Section, all dock license sites shall fully 39 comply with LMCD <br />regulations LMCD allows up to 4... <br />C. Docks. The license holder shall maintain only one dock at the dock license site. Understood that the <br />concept is to provide and dock and a boat, but the LMCD could allow them a variance up to whatever <br />amount of extension on the dock to get to 5' of Navigable water... What that means is, even though <br />these lots are not that wide, a 150+ dock like Minnetonka Beach has been allowed will allow multiple <br />boats to be along the inner part of the main dock and increase density... Maybe that is not an issue and <br />instead of the concept as I remember of trying to provide one boat/one dock; that might be your <br />thinking now... Every boat as we know does not require 4-5' of water depth to be able to dock... <br />E. Transferability <br />Dock space may not be rented. As you know I like that... <br />
