LA19-97 <br />ExA <br />Ordinance text <br />1 <br />2 Article VI Public Lakeshore, Lakeshore Rights of Way and Docks. <br />3 Subd. 38-900 Definitions. For purposes of this section, the following terms shall have the meaning given <br />4 them. <br />5 A. "Dock" shall mean any wharf, pier, boat ramp, boat slip, or other structure constructed or <br />6 maintained in, upon, or into the water of a lake from either public property or public rights of way. <br />7 B. "Public property or public rights of way" shall mean all publicly owned property and all public <br />8 rights of way that are immediately adjacent to a lakeshore, as designated on the dock location map to <br />9 be maintained at all times by the City pursuant to this Section. <br />10 C. "Dock accessories" shall mean all structures and materials used in conjunction with a dock <br />11 including but not limited to boat lifts, buoys, fences or other obstructions and permanent or semi - <br />12 permanent steps, ramps or other structures leading to the shoreline. <br />13 D. "Dock site" shall mean the property designated in the license issued pursuant to this Section and as <br />14 designated on the dock location map to be maintained by the City. <br />15 Subd.38-901 License required. No person shall erect, place, keep, or maintain a dock or other structure <br />16 from public property or public rights of way without a dock license. <br />17 Subd.38-902 Applications. Applications for dock licenses shall contain the following information and <br />18 such other information as the Council deems necessary: <br />19 A. Full name of applicant; <br />20 B. Address; <br />21 C. Preferred dock location on the dock location map and dock specifications; <br />22 D. Boat license number of any boats to be moored at the dock. <br />23 E. An application fee as established by the City Council. The application fee shall be refunded if the <br />24 applicant is not awarded a dock license. <br />25 F. Proof of ownership of Residential Lot. <br />26 Subd. 38-903 Eligible applicants. Property owners of land adjacent to city owned lakeshore parcels as <br />27 described in the table below are eligible to apply for a dock license for said site or sites.
