(hereinafter the "Developer") has an <br /> interest in the properties at 190 Willow Drive North and 177 Glendale Drive legally described in <br /> Exhibit A attached hereto (hereinafter the"Property"); and <br /> WHEREAS, the City Council has considered the application by the Developer <br /> for rezoning of portions of the Property to RPUD - Residential Planned Unit Development as <br /> well as subdivision and development of the Property by the Planned Unit Development (PUD) <br /> process; and <br /> WHEREAS, on February 13, 2006 the City Council adopted Resolution No. <br /> 5420 granting General Concept Plan Approval for the proposed development, which approval <br /> includes the following elements: <br /> 1. Subdivision platting of the Property to create eight developable single family residential <br /> building lots to be served by a new public road, as well as two additional lots <br /> encompassing the existing residence at 190 Willow Drive North and the. existing church <br /> at 177 Glendale Drive,to be designated as Lots 1 through 10; <br /> 2. Rezoning of Lot 1 and Lots 3 through 10 from RR-1B Single Family Rural Residential <br /> District to RPUD Residential Planned Unit Development District; <br /> 3.
