ORONO TREE ORDINANCE FOR DEVELOPERS <br /> TREE PRESERVATION AND REFORESTATION <br /> Application: This ordinance only applies to new building permits and <br /> developments in Orono. <br /> This ordinance does not apply to existing single family homes, multiple <br /> family homes, comrriercial developments or other existing property that <br /> does not require a building permit <br /> Definitions. <br /> The following words, terms and phrases, when used in this division, shall have the <br /> meanings ascribed to them in this section, except where the context clearly indicates a <br /> different meaning: <br /> Applicant—An owner, occupant, or a representative of an owner or occupant of a <br /> lot, parcel or tract of land for which an application has been filed for a subdivision, <br /> Special Use Permit, or any activity requiring the issuance of grading, building utility or <br /> demolition permits <br /> Caliper Inches refers to the diameter of a tree, and is measured in inches at a point 4.5 feet <br /> above the ground. <br /> Impacted tree. Any tree impacted by construction activity such that the tree will likely <br /> die (as deemed by a forestry specialist). Impacts can include but are not limited to <br /> grading changes affecting a tree's root system, mechanical injuries to the trunks of trees, <br /> compaction of soil, etc. <br /> Replacement trees must be at least two (2) caliper inches for deciduous trees and at least <br /> six (6) feet high for coniferous trees. <br /> Significant trees. A healthy deciduous tree measuring six (6) caliper inches or greater, or <br /> a healthy coniferous tree measuring four (4) caliper inches or greater. <br /> Tree. Means a woody plant which at maturity is greater than thirteen (13) feet in height <br /> and having a more or less definite crown. <br /> Trees to be protected(planned) means the identified seventy (70) percent or more of <br /> existing significant trees intended for protection. <br /> Trees to be removed(planned) means the entire list of trees planned for removal within a <br /> tree preservation plan or trees identified for removal in conjunction with a permitted <br /> activity. <br />
