Public Services Plan <br /> In these instances, the City will acquire permanent utility easements to <br /> allow such placement and to permit regular maintenance activities to <br /> occur. The typical easement is at least 10 feet and no more than 20 feet <br /> wide and does preclude any temporary or permanent construction over <br /> the sewer route. T'he existence of these underbround utilities and the <br /> appurtenant easement seldom affects the appearance or use of the <br /> property, other than the construction limitation. <br /> In addition to the above, all new subdivisions are required to include <br /> platted, dedicated public "drainage and utility" easements along most lot <br /> lines to facilitate lot drainage and the installation of utilities such as <br /> sewer, water, power and telephone without the need for separate legal <br /> instruments. <br /> Draina_e Easements. As in the case of utility easements, the City's <br /> topography often has resulted in natural drainageways running over <br /> privately owned property. Non-obstruction of the natural drainage system <br /> is protected by our local environmental ordinances because such natural <br /> systems often are not covered by legal easements. <br /> Draina�e easements are utilized where the City has constructed and/or <br /> maintains a storm drainage system across private property. These <br /> easements do legally record the non-obstruction requirements as well as <br /> provide for City� n�aintenance access. In addition, all new subdivisions are <br /> required to include platted, dedicated public "drainage easements" along <br /> all natural creeks and drainageways and over all designated marshland or <br /> wetland. <br /> Flowage & Conservation Easements ancf C'ol�enunts for Wetland and <br /> Wetl�rnd Buffer Protection. Orono's Environmental Preservation and <br /> Surface Water Manabement Plans, as well as certain City Ordinances. <br /> have identified and designated wetlands, marshland and flood plains <br /> throughout the City that are to be permanently protected and preserved <br /> from encroachment or alteration. Whenever land containing such features <br /> is subdivided or developed, the City will require the land owner to <br /> dedicate a permanent flowage and conservation easement to the City over <br /> the affected portion of his land. <br /> Flowage and Conservation easements and wetland covenants identify the <br /> protected area and preclude construction of any structures, hardcover or <br /> other improvements inconsistent with the natural state of the land; <br /> prevent removal of any vegetation, earth or soil; pre��ent dredgin�, <br /> excavation or filling; and prevent any use of the land that would chan�e <br /> or alter the natural condition of the Land, or would tend to change the <br /> drainage, flood control, water conservation, erosion control, soil <br /> conservation or fish and wildlife habitat characteristics of the land or the <br /> water situated thereon. <br /> City of Orono Community Management Plan 2008-2030 Page 4F-33 <br />
