O CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Sections 10.22, Subdivision 1 (B); 10.22, <br /> Subdivision 2; and 10.25, Subdivision 6 (B) to permit the construction of a two story addition <br /> and lakeside deck requiring an average lakeshore setback variance of 8', a side setback variance <br /> of V or 90% and approval of hardcover excesses within the 75-250' setback area where <br /> improvements are proposed, hardcover to be maintained at 6,293 s.f. or 58.27%, subject to the <br /> following conditions: <br /> 1. All existing hardcover improvements scheduled for removal must be completed <br /> prior to the footing inspection for the new residential construction. <br /> 2. Authorities granted by this variance run with the property not with the applicants, <br /> but are permissive only and must be exercised by application for a building <br /> permit within one year of the date of Council approval, or this variance will <br /> expire on that date (May 10, 1994). <br /> 3. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 4. The undersigned applicants have read, understood and hereby agree to the terms <br /> of this resolution and on behalf of themselves, their heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the chain of title of the <br /> property. <br /> Adopted by the Orono City Council on this 10th day of May, 1993. <br /> A T: <br /> or y M all' , City Clerk Edward J.
