CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> FSHC No. 6476 <br /> 3. The Planning Commission reviewed this application on November 17, 2014, <br /> the Planning Commission voted on a motion to approve the requested <br /> variances on a 5 to 0 vote conditioned upon the following: <br /> a. The proposed new stair off of the addition should be revised to <br /> meet the 75-foot setback; <br /> b. Hardcover shall not exceed 33.6%; and <br /> c. Compliance with the City Engineer's requirements. <br /> 4. On November 17, 2014, the Planning Commission's actions were based on <br /> the following findings. <br /> a. The Property has approximately 23,662 square feet (0.54 acre) acre in <br /> area and has 79 feet in width at the OHWL and 70 feet at the 75-foot <br /> setback. <br /> b. The Property is located in Tier 1 of Orono's Stormwater Quality <br /> Overlay District and is limited to 25% hardcover based on gross lot <br /> area. <br /> c. The Applicants' proposal results in a reduction in existing hardcover by <br /> 157 square feet. <br /> d. The additions to the home are proposed to be constructed over the <br /> existing deck footprint. The addition will improve an existing <br /> encroachment into the setback for the most lakeward portion of the <br /> home. <br /> e. The proposed addition is not out of character with the neighborhood <br /> and will meet the lake and average lakeshore setbacks. <br /> f. The variance to allow construction over the existing home within the 10 <br /> foot side setback will alleviate a practical difficulty inherent to the <br /> Property's width and not created by the Applicant. <br /> g. The Applicant's request to construct the addition partially within the <br /> side setback will not alter the essential character of the neighborhood <br /> and will result in minimal negative impact on adjacent properties. <br /> h. The Applicant's request is in harmony with the purpose and intent of <br /> the ordinance. <br /> i. The Applicants' proposal is consistent with the comprehensive plan. <br /> Page 2 of 5 <br />
