Accordingly, this requires upgrade of the SSTS due to the fact that it is not designed to properly serve the number of bedrooms according to Section 58-77 of the Orono City Code and MPCA Rules 7080-7084. A design was completed for an upgrade to this existing system and was received by the City on October 17, 2014 and is herein referenced as Exhibit A. The system cannot be properly installed this year due to the impending winter weather conditions and the availability of a certified installer to complete the work in a timely manner. The designer indicated that the drain field meets required ground water protection separation and is properly functioning, although the tanks are considered non-compliant by failing to protect ground water and must be replaced. The owner(s) hereby enter into an agreement for SSTS upgrade on or before July 15, 2015,or prior to occupancy of the building addition,whichever occurs later. By entering into this agreement, Owners assure the City they will retain the services of an MPCA Licensed SSTS Installer to permit and install a new SSTS upon the parcel according to MN Rules 7080- 7083 and Section 58 of the City SSTS Code requirements.
